1. Introductory provisions
1.1 These terms and conditions (the “Terms”) govern the mutual rights and obligations between the operator of the GoApp service, Lusam shop, s.r.o., with its registered office at Korunní 108, 101 00 Prague, Company ID (IČO) 22515259, registered in the Commercial Register kept by the Municipal Court in Prague, file no. C 416917, which is not registered for VAT (the “Operator”), and the user of the service.
1.2 Contact details of the Operator: email info@goapp.cz, registered office address Korunní 108, 101 00 Prague.
1.3 The Service is intended for entrepreneurs and legal entities for their business activities. By registering, the User confirms that they use the Service in the course of their business activities. The Service is not intended for consumers, and the contract is not a consumer contract.
1.4 Legal relationships not governed by these Terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.
2. Definitions
- Service – the GoApp web application available at app.goapp.cz, including the public API, the module for PrestaShop, and the plugin for WordPress and WooCommerce.
- User – an entrepreneur or legal entity that has set up a user account in the Service.
- Output – content created by the Service using artificial intelligence based on the User’s request, such as texts, metadata, ads, structured data, pages, or websites.
- Plan – the scope of the Service and its limits (monthly credits, number of online stores and products, available features) according to the price list published at goapp.cz.
- Credit – a unit that the User spends on creating outputs. The number of credits for individual features is stated in the price list and in the application before generation starts.
- Demo access – access to the Service, limited in time and scope, that the Operator makes available to a User individually, for example to demonstrate the Service on the User’s products.
- AI providers – third parties whose language models the Service uses to create outputs (Anthropic, OpenAI, and Google).
- User data – the product catalog, texts, images, settings, and other content that the User enters into the Service or has synchronized into it.
3. Registration and user account
3.1 Use of the Service requires registration. The User must provide true and complete information and update it without undue delay.
3.2 The Operator may verify and approve a registration manually before the account is activated. The Operator may refuse a registration, in particular if it has reasonable grounds to suspect misuse of the Service.
3.3 The contract between the Operator and the User is concluded at the moment the account is activated.
3.4 The User must protect their login credentials and API tokens against misuse and is responsible for any activity carried out under their account. The User shall report any suspected misuse of the account without undue delay to info@goapp.cz.
4. Scope of the Service
4.1 The Service enables, in particular, importing the catalog and website content (product feeds, API, module, and plugin), creating outputs using artificial intelligence (texts, ads, analyses, newsletters, pages, and websites), editing the content of connected systems according to the User’s instructions (AI assistant), approving outputs and changes, publishing them to the User’s connected systems, exporting outputs, and creating websites for download. The range of available features is determined by the plan.
4.2 The current range of features is described on the goapp.cz website and in the application. The Operator may develop, change, or replace features, provided that this does not substantially reduce the scope of the paid plan in the current period.
4.3 The Operator selects the specific artificial intelligence models for individual features and may change them, in particular with regard to quality, price, and availability with the AI providers.
4.4 The Operator makes reasonable efforts to keep the Service available at all times; however, unavailability cannot be ruled out (maintenance, outages of AI providers, hosting, or the network). Guaranteed availability can only be agreed in a written agreement.
5. Plans, subscriptions, and payment terms
5.1 The Operator may grant the User demo access to the extent and for the period communicated to the User; once it ends, the Service may only continue to be used under a paid plan. Paid plans and credit packs are provided at the price according to the price list valid at the time they are ordered.
5.2 The Operator is not registered for value added tax (VAT). The prices stated are final.
5.3 Plan prices are stated per month. The plan is paid in advance for the selected subscription period: 3 months, 6 months with a 5% discount, or 12 months with a 10% discount on the price for the corresponding number of months (price for the period = monthly price × number of months × (1 − discount)). The current periods and discounts are stated in the price list at goapp.cz and in the application when ordering. The Operator may individually allow a specific User to pay month by month.
5.4 The User orders a plan on the goapp.cz website using the Order button (together with registration and billing details); a plan or credit pack may then also be ordered in the application or by email. The Operator reviews the order and sends the User a proforma invoice with payment details by email; the Operator may also decline the order. Once the payment has been credited, the Operator issues an invoice (proof of payment) and activates the plan or credits. A User who ordered a plan at registration gains access to the account only once the payment has been credited. The paid period starts on the day of activation; in the case of a renewal, it follows on from the end of the current paid period or, if that period has already ended, starts on the day the payment is credited. The proforma invoice is due within 7 days of its issue; payment is made by bank transfer on the basis of the proforma invoice. The Service (the account, the ordered plan, or credits) is made available only after the payment has been received in the Operator’s account. The subscription does not renew automatically, and nothing is charged automatically.
5.5 The Operator may agree with the User on an individual price or scope of the plan (in particular for the Enterprise plan, which has no list price). An individual agreement takes precedence over the price list.
5.6 The User receives the plan’s monthly credits every month throughout the paid period. Unused monthly credits do not roll over to the following month.
5.7 Additionally purchased credits (credit packs) are valid for 12 months from activation and are used only after the plan’s monthly credits have been used up, starting with those closest to expiry. No credits are deducted for failed generations. Unused credits are neither refunded nor paid out in cash; they expire at the end of their validity.
5.8 The Operator notifies the User by email, at the account address, of the approaching end of the paid period (14, 7, and 1 day in advance). If the User does not renew the subscription, the account switches to read-only mode once the paid period ends (in the case of demo access, once it ends): the User can log in, see their data, and export outputs, but cannot create new outputs or edit, publish, or synchronize content; integrations and the API allow reading only. Ordering a renewal, support, and changing the password remain available. Once the renewal payment has been credited, the account is unlocked.
5.9 Once 6 months have elapsed since the end of the paid period, the Operator archives the account: logging in to the account, integrations, and the API stop working, and the data remains stored. An archived account may be restored by the Operator at the User’s request (GoApp support at info@goapp.cz).
5.10 Once 12 months have elapsed since the end of the paid period, the Operator irreversibly deletes the account, including all of the User’s data (catalogs, outputs, websites, newsletters, and uploaded files). At the User’s request, the Operator may postpone the deletion or restore the account. The Operator informs the User by email of the switch to read-only mode and of the upcoming archiving and deletion (30 and 7 days in advance).
5.11 The Operator announces price changes to users of paid plans at least 30 days in advance. If the User does not agree with the change, the User may terminate the contract as of the date the change takes effect.
6. Limits and use of the Service
6.1 Use of the Service is limited by the limits of the plan or, where applicable, by individually agreed limits (available credits, number of online stores and products, available features, and, where applicable, daily limits). Once the credits have been used up, no further outputs can be created until they are renewed or additional credits are purchased.
6.2 The User must not circumvent the limits, in particular by creating multiple accounts or by automated access outside the public API, nor place a load on the Service beyond the scope of normal use.
7. AI outputs and responsibility for content
7.1 Outputs are created automatically by artificial intelligence. They may contain inaccuracies, errors, or statements that do not correspond to reality. The Operator is not responsible for the factual accuracy, completeness, or suitability of outputs for a particular purpose.
7.2 The User must check outputs before publishing or otherwise using them. The User is responsible for content published on their website, in their online store, in ads, or elsewhere, including compliance with regulations on advertising and consumer protection and with the rights of third parties.
7.3 The Operator claims no rights to outputs, and the User may use them without restriction within the scope of their activities. The Operator does not guarantee that outputs will be unique or that they will be protected under copyright law.
7.4 Features with web search work with publicly available third-party information whose accuracy the Operator does not verify.
8. User data
8.1 Rights to user data remain with the User. The User grants the Operator a non-exclusive authorization to store and process the data and to transfer it to AI providers to the extent necessary to provide the Service, for the duration of the contract.
8.2 The User declares that they hold the necessary rights to the data they enter into the Service and that this data does not contain any content that violates the law.
8.3 If user data contains personal data of third parties, the Operator processes it for the User as a processor, solely for the purpose of providing the Service. Details are set out in the personal data processing terms in clause 8.5. The processing of the User’s personal data is described in the Privacy Policy.
8.4 The User may export outputs at any time, including in read-only mode. The data of an account without a paid subscription is deleted in accordance with clause 5.10. After the contract ends, the Operator deletes the user data at the User’s request within 30 days, except for data whose retention is required by law.
8.5 Personal data processing terms (Article 28 GDPR). As a processor, the Operator processes personal data contained in user data only on the User’s instructions given by these Terms and by the settings of the Service, for the duration of the contract and solely for the purpose of its performance. The Operator ensures that persons authorized to process the data are bound by confidentiality, adopts appropriate technical and organizational measures (encryption in transit, separation of users’ data, access control, backups), assists the User in handling requests from data subjects exercising their rights and in fulfilling the obligations under Articles 32 to 36 GDPR, and informs the User of any security breach without undue delay. The User grants general authorization to engage the other processors listed in the Privacy Policy (in particular hosting and AI providers); the Operator informs the User of any changes. After the contract ends, the Operator deletes the data in accordance with clause 8.4 and, upon request, demonstrates compliance with the obligations under this clause.
9. Integrations, API, and plugins
9.1 The User installs the PrestaShop module and the WordPress plugin into their system at their own risk. We recommend making a backup before installation and before bulk publishing.
9.2 Publishing writes to the User’s system only those fields, and only in the mode, that the User has allowed in the integration settings. The module and the plugin store the original values so that changes can be reverted. The Operator is not liable for damage caused by unsuitable integration settings or for incompatibility with the User’s other modules, plugins, or themes.
9.3 API tokens are confidential. The User may revoke them and create new ones in the application at any time.
10. Prohibited use
The User must not use the Service, in particular:
- to create content that is unlawful, misleading, or infringes the rights of third parties;
- to send unsolicited commercial communications;
- to attempt unauthorized access to the Service or to the data of other users, or to compromise the security and stability of the Service;
- in breach of the usage policies of the AI providers;
- to resell the Service or make it available to third parties without the Operator’s written consent.
In the event of a breach of these rules, the Operator may suspend the account or terminate the contract in accordance with Article 12.
11. Liability
11.1 The Operator is not liable for lost profits or for damage resulting from content published by the User, incorrect integration settings, outages of AI providers, hosting, or networks, or interventions by third parties that the Operator could not influence.
11.2 The Operator’s total liability for damage is limited to the amount of the most recent payment the Operator received from the User. This limitation does not apply to damage caused intentionally or through gross negligence, or to other cases where the law does not permit it.
12. Term and termination of the contract
12.1 The contract is concluded for an indefinite period.
12.2 The User may terminate the contract at any time by sending a request to cancel the account to info@goapp.cz. For a paid plan, the contract ends when the paid period expires; the price paid is not refunded.
12.3 The Operator may terminate the contract with a notice period of 30 days. In the event of a material breach of the Terms, in particular Article 10, the Operator may terminate the contract with immediate effect.
13. Changes to the Terms
The Operator may reasonably amend these Terms. The Operator informs the User of a change by email or in the application at least 30 days before it takes effect. If the User does not agree with the change, the User may terminate the contract by the date the change takes effect. By continuing to use the Service after the change takes effect, the User expresses agreement with the change.
14. Final provisions
14.1 The parties communicate with each other electronically: the Operator at the email address of the User’s account and the User at info@goapp.cz.
14.2 Disputes shall be resolved before the general courts of the Czech Republic. The court with local jurisdiction is the general court of the Operator (Prague).
14.3 If any provision of these Terms is invalid or ineffective, this does not affect the validity of the other provisions.
14.4 These Terms take effect on October 7, 2026.
